Mediation is a process people
sometimes elect to use in divorce, domestic partnership dissolutions and
custody cases where you and your spouse, partner, or other parent meet
with a neutral facilitator who can assist you in reaching agreements between
yourselves. The mediator does not make a decision or advocate for
either party. In the event you are successful in reaching an agreement,
you will still need to retain independent counsel to review the terms of
the agreement, to convert it into the appropriate legal format, and, in
divorce cases, to process your divorce case through the courts in order
to obtain a final decree. We recommend that the participants in mediation
consult with independent counsel from the beginning of the process to assure
that they have the benefit of legal advice and education we, as neutral
mediators, are not allowed to provide.
Three of our attorneys (Joni
Berner, Margaret Klaw and Megan
Watson) are trained as mediators. If you and your spouse/other
parent would like to retain one of us to be your mediator, our firm cannot
represent either of you; we will need to refer you to other counsel. Similarly,
if we represent you, you and your spouse/other parent cannot use another
lawyer at Berner & Klaw to mediate your case. |
