In general, we bill you
for the time spent on your case; we do very little work on a flat fee basis
since the time involved in cases varies so greatly.

At the beginning of your
representation, we will ask you for an advance fee based on the type of
case and our assessment of the amount of time it may take to resolve it.
This amount is NOT a flat fee – your actual legal fees and costs may be
more or less. The advance fee amount will be discussed in your initial
consultation and reflected in the fee agreement we send you. When
you send back the signed fee agreement, you will also send a check (or
give us the necessary information for a Visa or Mastercard payment), for
the advance fee amount which we then deposit in our trust account.
Pennsylvania’s Rules of Professional Responsibility require that the interest
earned on trust accounts of this nature be paid to a state trust fund.
You will receive monthly billing statements from us which show, in increments
of .1 per hour (or six minutes), the work done on your case and the corresponding
amount of funds transferred from your trust balance to Berner & Klaw
as payment. It is our policy, except in certain cases where other
arrangements are made with your attorney, for each client to keep a minimum
of $1,000 in the trust account, so we expect you to replenish the trust
account when your balance dips below this amount. If you have money
in the trust account at the conclusion of your case, we will refund it
to you. |
